These Terms of Service (“Terms”) govern your use of the website, bookings, and services of Hawaii Efoil Experience LLC (“Hawaii Efoil Experience,” “we,” “us,” or “our”). By booking with us, using our website, or opting in to our text messages, you agree to these Terms.

Our services

Hawaii Efoil Experience offers private eFoil and wing foil lessons and sessions on Oahu, eFoil battery rentals with hotel or rental delivery, remote owner consultations, and gift cards. Lesson details, prices, and times are shown at booking.

Bookings and payment

Bookings are made through our online booking platform and paid in full at booking unless stated otherwise.

You must give accurate information when booking, including each rider’s name, contact details, and experience level.

Prices are in US dollars and may change, but the price you paid at booking will not.

Cancellations, rescheduling, and refunds

24 hours or more before your lesson: full refund.

Less than 24 hours before, or no-show: the full price is charged. You may be able to rebook within 30 days, subject to availability, for a $100 rebooking fee.

Weather: we may cancel any lesson at any time for weather or water conditions. If we cancel, you can reschedule or get a full refund.

Approved refunds go back to your original payment method within 7 days. A receipt or proof of purchase is required.

Gift cards are not refundable.

We recommend trip protection if you may need to cancel within 24 hours.

Rider requirements and safety

Riders must be at least 16 years old, weigh no more than 300 lbs, and be able to swim. Riders under 18 must have a parent or guardian book and consent for them.

All riders must sign our liability waiver before getting on the water.

You must wear the safety gear we provide and follow your instructor’s directions at all times.

We may end or shorten a lesson without a refund if a rider acts unsafely, ignores instructions, or appears to be under the influence of alcohol or drugs.

Tell us before your lesson about any medical condition that could affect your safety.

Assumption of risk

eFoiling and wing foiling are water sports with real risks, including falls, collisions, equipment contact, ocean conditions, and marine life. By taking part, you accept these risks to the fullest extent permitted by law.

Equipment and battery rentals

You are responsible for rented equipment from delivery until pickup. Use it only as instructed and keep batteries away from heat and water damage.

You are responsible for loss, theft, or damage beyond normal wear, up to the cost of repair or replacement.

Rentals must be ready for pickup at the agreed time and place.

SMS / text messaging terms

Program: Hawaii Efoil Experience customer texts.

Message types: Non-marketing texts, such as booking confirmations, lesson reminders, weather or schedule changes, and replies to your questions, are part of booking with or contacting us. Marketing texts, such as special offers, are sent only if you opt in.

Frequency: Message frequency varies.

Costs: Message and data rates may apply.

Opt out: Reply STOP, STOPALL, or UNSUBSCRIBE to any message. You will receive one confirmation text, and no further texts unless you opt in again.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Consent: Consent to receive marketing texts is not a condition of any purchase.

Privacy: Your information is handled as described in our Privacy Policy. We do not share your mobile opt-in data or consent with third parties.

Photos and videos

We may take photos or video during your lesson to share with you. We will only post them publicly with your permission.

Acceptable use

You may not use our website or services for unlawful, abusive, or misleading purposes.

Limitation of liability

To the fullest extent permitted by law, Hawaii Efoil Experience is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid for the booking that the claim relates to. Nothing in these Terms limits liability that cannot be limited under Hawaii law.

Governing law

These Terms are governed by the laws of the State of Hawaii. Any dispute will be resolved in the state or federal courts located in Honolulu, Hawaii.

Changes to these Terms

We may update these Terms from time to time and will change the “last updated” date. Booking with us after an update means you accept the updated Terms.
